*‘Owner’ means Silent Disco Bunbury and its substitutes, successors and permitted assigns and its licensees, franchisees and/or agents;
*If you are not present at the time of your booking, your booking will be cancelled. Please read our Cancellation Policy below for more details.
- ‘Hirer’, ‘Purchaser’, ‘User’, or ‘You’ refers to any individual or entity using the equipment. Use of the equipment is at your own risk.
Hiring Conditions
By hiring equipment from Silent Disco Bunbury, you agree to the following terms and conditions. Silent Disco Bunbury will provide you with the equipment you have requested for hire, in working order, on the date(s) you have booked.
Please make sure that you have thoroughly looked over and checked your equipment, when you receive the equipment, you will be responsible for it once it has been received, and until it is returned. All equipment provided, including but not limited to, headphones, transmitters, storage containers, cables, power boards, lighting, smoke machines and other equipment needs to be stored securely and returned in the same condition as they were when you received them.
Silent Disco Bunbury ensures all equipment is checked, charged, cleaned and counted before it is provided to you. Should any equipment not be packed or working upon delivery, please contact Silent Disco Bunbury immediately so that we can assist you. Silent Disco Bunbury reserves the right to not issue a refund if nothing is reported once we, the owner, have provided you the equipment and it is out of our possession.
Driver's License or valid ID (such as a passport, or other government issued ID) will be requested upon delivery or pick-up of your equipment. Please ensure you bring it with you (We comply with the Privacy Act of 1988).
Delivery or Pick-up of Equipment
Silent Disco Bunbury can offer you the option to pick-up equipment from our business location, or we can deliver the equipment to you for an additional cost; this cost will be included in your invoice (unless prior arrangements have been made). Silent Disco Bunbury will provide their best efforts to have all equipment that is hired from us, to be ready for collection at our business, or delivered to you, on the date that has been arranged. Under these terms and conditions Silent Disco Bunbury is not liable for any failure to deliver or delay in delivery for any reason outside of our control.
Returning Equipment
All the equipment should be checked and packed back into the storage containers which will be provided for you. Equipment hired needs to be returned at the agreed upon time and location, and unless specified during booking, is 7 days after delivery or pick-up at the same location as the delivery or pick-up was made. Equipment that is not returned on time will incur an additional fee which will be decided by Silent Disco Bunbury and will be billed each day until the equipment is returned, unless prior arrangements have been made. Equipment may be returned earlier than 7 days after delivery or pick-up was made; please notify us if you would like your equipment picked up/dropped off before this time.
Liability
Silent Disco Bunbury is not responsible for any damages, injuries or any negative consequences that may occur with the use of our equipment once it is in the possession of the hirer/purchaser/user (you). The hirer/purchaser/user agrees that the use of the equipment carries with it dangers and risks of injury and the hirer/purchaser/user agrees to accept all dangers and risks associated with this equipment.
In no case shall Silent Disco Bunbury, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Indemnity
To the full extent permitted by law the hirer/purchaser/user (you) releases, discharges, indemnifies and hold harmless Silent Disco Bunbury and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Damage or Loss of Equipment
If any headphones, transmitters, cables, power boards, lights, smoke/bubble machines, storage containers and/or other equipment are lost or damaged, you will be liable for the replacement cost. The cost of replacement will be: $100.00 per headphone and $150.00 per transmitter which will need to be paid upon collection of the equipment. Costs may also be charged for damaged or missing equipment such as, but not limited to, party lights ($100 per light), smoke/bubble machine ($150 per machine), cords/cables ($15 per cord/cable), power boards ($25 per power board), and/or storage containers ($25 per storage container). Silent Disco Bunbury has the right to charge you these damage costs directly to your chosen debit or credit card, and will need to be paid upon, or before collection of the equipment, or as specified by Silent Disco Bunbury.
Orders
We will try to fulfil all our orders, however if we are unable to fulfil your order due to any reason, we will refund you in whole, and offer an alternative option.
Repossession
Silent Disco Bunbury has the right to retake possession of the equipment if you breach any provision of this agreement.
Costs
We will require a full payment to confirm the booking you have made. Your booking may be cancelled if payment has not arrived by the established pick-up or delivery time.
Promotions/Discounts
All applied coupons will also reduce the price of the bond by the percentage of the coupon that is used, if a bond is applicable.
Cancellation Policy
Once you have booked your equipment and paid for it, any changes or variations may be made up to 48 HOURS before your booking time, provided we are able to fulfil this change or variation. Cancelling within SEVEN (7) DAYS of your booking time will incur a 100% termination/cancellation fee. If a deposit is made it is non-refundable. If you decide to cancel your booking, Silent Disco Bunbury may retain your payment. This payment can be used for future events if we have the capacity to do so.
If you are not present at the time of your booking this will be considered a cancellation. Please be on time. Silent Disco Bunbury is not responsible for any loss of payment due to late arrival. Please call ahead of time if you need to arrange an alternative collection time.
All refunds are subject to a minimum fee of $5.
Privacy Act
Silent Disco Bunbury only collects and keeps information that you provide that is essential in completing and delivering your order. We follow in accordance with the Privacy Act of 1988 and will never distribute or sell your information. Once your equipment has been collected and assessed for damages, we will delete all your information, unless you tell us otherwise.
COVID Policy
We ensure that all our equipment is cleaned and sanitised after every hire. If your event is cancelled due to COVID restrictions, please let us know immediately and we may be able to provide you with a credit up to the amount that you spent on your order. Our Cancellation Policy above will still apply for all orders.

The use of the Silent Disco Bunbury and the Silent Disco Bunbury website is at your sole risk. It is your responsibility to ensure that any products, services or information provided through this website meet your specific requirements. Silent Disco Bunbury is not responsible for any injury or damage done with the use of our equipment.
