Terms and Conditions of Hire – Silent Disco Bunbury
Please read carefully before proceeding with any booking. By hiring our equipment, you acknowledge and agree to the following terms and conditions. This is a legally binding agreement.
Any updates, revisions, or changes made to these terms and conditions will automatically be deemed accepted by you upon your continued use of our services.
The term "Owner" refers to Silent Disco Bunbury, including its affiliates, successors, licensees, agents, and franchisees.
If you are not present at the agreed time of your booking, your reservation may be forfeited. Please review our Cancellation Policy for more details.
"Hirer", "Purchaser", "User", or "You" refers to the individual or organisation renting the equipment. Use of our equipment is entirely at your own risk.
Silent Disco Bunbury will provide the agreed-upon equipment in functioning condition on the date specified in your booking. Please inspect all items upon receipt. Once the equipment is in your possession, you are responsible for its care and condition until it is returned.
All items supplied — including but not limited to headphones, transmitters, power cables, storage boxes, lighting units, smoke or bubble machines — must be stored safely and returned in the same condition they were received.
We inspect, clean, charge, and test all equipment before it is hired out. If anything appears to be missing or not working correctly upon delivery or pick-up, please contact us immediately. Refunds may not be issued for issues not reported at the time of receiving the equipment.
A valid government-issued ID (such as a driver’s license or passport) is required upon collection or delivery. We comply fully with the Australian Privacy Act 1988.
You can choose to collect the equipment from our location or opt for delivery at an additional fee, which will be added to your invoice unless otherwise arranged. We aim to have all equipment ready for pick-up or delivered on the date you’ve scheduled. However, we are not liable for delays or failure to deliver due to factors beyond our control.
All equipment must be returned packed in the original containers provided. The default return time is within 7 days of pick-up or delivery unless otherwise stated in your booking. Late returns will incur additional daily charges determined by Silent Disco Bunbury, unless prior arrangements are made.
Early returns are welcome — just let us know if you'd like to return or arrange pick-up earlier than planned.
Silent Disco Bunbury is not responsible for any damages, injuries or any negative consequences that may occur with the use of our equipment once it is in the possession of the hirer/purchaser/user (you). The hirer/purchaser/user agrees that the use of the equipment carries with it dangers and risks of injury and the hirer/purchaser/user agrees to accept all dangers and risks associated with this equipment.
In no case shall Silent Disco Bunbury, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
To the full extent permitted by law the hirer/purchaser/user (you) releases, discharges, indemnifies and hold harmless Silent Disco Bunbury and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
You are financially responsible for any equipment that is lost or damaged. Replacement costs are as follows (subject to change):
Headphones: $100 each
Transmitters: $150 each
Party lights: $100 each
Smoke/bubble machines: $150 each
Cords/cables: $15 each
Power boards: $25 each
Storage containers: $40 each
We reserve the right to charge your nominated credit/debit card for any such losses or damages, and payment is expected upon or before collection unless otherwise agreed.
While we do our best to fulfil all bookings, if we are unable to complete your order, we will provide a full refund and offer an alternative option if available.
Silent Disco Bunbury reserves the right to recover the hired equipment immediately if you breach any part of this agreement.
Full payment is required to confirm any booking. If payment is not received by the time of delivery or pick-up, the booking may be cancelled.
Changes or cancellations may be made up to 48 hours before the scheduled booking time, subject to availability. Cancellations made within 7 days of the booking date will forfeit 100% of the booking fee. All deposits are non-refundable. Payments made may be credited to a future event, depending on availability.
If you do not show up at the agreed time, it will be treated as a cancellation. Please arrive on time and call ahead if you need to reschedule.
All refunds, where applicable, are subject to a minimum $5 processing fee.
We collect only the personal information necessary to process your booking. Your information will not be shared or sold, and is managed in accordance with the Australian Privacy Act 1988. Your data will be deleted once your hire period has ended and equipment has been assessed, unless you request otherwise.
Use of Silent Disco Bunbury services and website is entirely at your own risk. It is your responsibility to ensure the equipment and services meet your individual requirements. We are not liable for any injuries or damages resulting from the use of our equipment.
